These Terms of Service (“Terms”) govern your access to and use of LINA, LINA Lens, our browser extensions, websites, applications, assessments, reports, coaching tools, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

2. About the Services

UniquelyND provides AI-powered tools designed to help individuals and organizations better understand communication, explore potential interpretations, improve decision making, identify opportunities for growth, and develop practical workflows and operating systems.

Services may include:

• Communication analysis
• Communication coaching
• Message interpretation
• Risk assessments
• Organizational assessments
• Role assessments
• AI opportunity discovery
• AI Playbooks
• Reports and recommendations
• Templates and workflows
• Operating system frameworks

• Browser extensions

Features may change, be modified, or be discontinued at any time.

3. Eligibility

You must be at least 13 years old to use the Services.

If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or legal guardian.

You represent that all information you provide is accurate and complete.

4. Accounts

You are responsible for:

5. AI Generated Content

The Services utilize artificial intelligence and large language models to generate analyses, recommendations, coaching suggestions, reports, assessments, and other outputs.

AI-generated content may:

• Be inaccurate
• Be incomplete
• Be outdated
• Reflect multiple possible interpretations
• Contain errors
• Produce unexpected or undesirable results

You acknowledge that AI outputs are informational only and should not be treated as facts, guarantees, or professional advice.

You remain solely responsible for evaluating and verifying all information before relying upon it.

6. Communication Analysis and Coaching

LINA may provide interpretations of messages, identify possible meanings, assess tone, intent, nuance, or risk, and offer coaching suggestions.

Communication is inherently subjective.

The Services do not determine what a sender actually intended.

Instead, the Services provide possible interpretations based on available information.

Users remain solely responsible for:

• Their communications
• Their decisions
• Any messages they send
• Any actions they take based on the Services

UniquelyND is not responsible for misunderstandings, relationship outcomes, employment consequences, legal disputes, or other outcomes arising from the use of the Services.

7. LINA Lens Assessments and Recommendations

LINA Lens may generate assessments, reports, playbooks, recommendations, operating frameworks, workflow suggestions, AI adoption opportunities, implementation guidance, or other strategic outputs.

These outputs are intended for informational and educational purposes only.

UniquelyND does not guarantee:

• Business outcomes
• Productivity improvements
• Revenue growth
• Cost savings
• Employment outcomes
• Organizational success
• AI implementation success

Users are solely responsible for evaluating and implementing any recommendations.

8. Public Information Analysis

The Services may analyze:

• Public websites
• Public documents
• Public social media content
• Public business information
• Information provided by users

Users represent that they have the right to submit any information they provide for analysis.

UniquelyND does not guarantee the accuracy, completeness, legality, or availability of third-party information.

9. No Professional Advice

The Services do not provide:

• Legal advice
• Medical advice
• Psychological advice
• Mental health treatment
• Financial advice
• Investment advice
• Tax advice
• Employment advice
• Human resources advice

You should consult qualified professionals before making decisions involving these areas.

10. No High-Risk Decision Making

The Services may not be used as the sole basis for decisions regarding:

• Termination

• Compensation

• Insurance
• Credit
• Education
• Government benefits

• Medical treatment

Users remain solely responsible for all decisions and outcomes.

11. Acceptable Use

You agree not to:

• Attempt to reverse engineer the Services
• Circumvent security measures
• Interfere with the operation of the Services
• Use the Services to violate another person's rights
• Upload content you do not have the right to use
• Misrepresent AI-generated outputs as professional advice

We reserve the right to suspend or terminate access for violations of these Terms.

12. Intellectual Property and Ownership

Customer Content

Users retain ownership of the information, communications, files, documents, materials, and other content they submit to the Services (“Customer Content”).

By using the Services, users grant UniquelyND the limited rights necessary to process, analyze, store, display, transmit, and otherwise use Customer Content solely for the purpose of operating, improving, securing, and providing the Services.

UniquelyND Intellectual Property

UniquelyND retains all rights, title, and interest in and to:

• The Services
• Software and source code
• Product designs
• User interfaces
• Frameworks
• Templates
• Prompt libraries
• Taxonomies
• Methodologies
• Assessment models
• Scoring systems
• Workflow architectures
• Operating system designs
• Reports structures
• Documentation
• Trademarks
• Trade secrets
• Copyrights
• Other proprietary technology and intellectual property

Nothing in these Terms transfers ownership of UniquelyND intellectual property to users.

Derived and Redacted Data

To the extent permitted by law, UniquelyND may create and retain redacted, anonymized, aggregated, transformed, statistical, or derived information generated through operation of the Services.

Such information does not include information intended to directly identify individual users and may be used to:

• Improve the Services
• Develop new features
• Measure product performance
• Conduct research
• Enhance security and reliability
• Develop future products and offerings

All rights in such derived, aggregated, anonymized, and redacted information belong to UniquelyND.

Research and Product Improvement

UniquelyND may use redacted, anonymized, aggregated, transformed, statistical, and derived information generated through operation of the Services for purposes including:

• Improving existing products and services
• Developing new products and services
• Improving assessment methodologies
• Enhancing communication analysis models
• Enhancing coaching frameworks
• Developing role and organizational frameworks
• Measuring product effectiveness
• Conducting internal research and analysis
• Improving system performance, reliability, and security

Such information will not intentionally include data that directly identifies an individual user, customer, employee, organization, or specific communication.

UniquelyND will not use customer-submitted content to train third-party general-purpose AI models.

All rights, title, and interest in research outputs, methodologies, aggregated findings, derived insights, and improvements resulting from such activities remain the exclusive property of UniquelyND.

Reports, Playbooks, and Operating Systems

The Services may generate reports, assessments, recommendations, AI Playbooks, operating systems, templates, workflows, role frameworks, organizational frameworks, and related deliverables.

Customers may use these deliverables for their own personal, internal organizational, or business purposes.

However, ownership of the underlying methodologies, frameworks, templates, prompt architectures, operating system designs, assessment models, workflow structures, and platform technology remains exclusively with UniquelyND unless otherwise agreed in writing.

Feedback

If a user provides suggestions, ideas, recommendations, enhancement requests, or other feedback regarding the Services, UniquelyND may use such feedback without restriction or compensation.

13. Subscription Services

Certain Services may require payment.

Subscriptions may automatically renew unless cancelled.

Fees are non-refundable except where required by law or expressly stated otherwise.

UniquelyND may modify pricing upon reasonable notice.

14. Beta Features

Certain features may be identified as beta, preview, experimental, or early access features.

These features may:

• Change significantly
• Produce inaccurate results
• Become unavailable without notice

Beta features are provided “as is” without additional warranties.

15. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNIQUELYND DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• AVAILABILITY

UNIQUELYND DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETELY ACCURATE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNIQUELYND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

UNIQUELYND’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT PAID BY YOU TO UNIQUELYND DURING THE PREVIOUS TWELVE MONTHS; OR

(B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

17. Indemnification

You agree to defend, indemnify, and hold harmless UniquelyND and its affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Services
• Your content
• Your violation of these Terms
• Your violation of applicable laws or third-party rights

18. Termination

We may suspend or terminate access to the Services at any time if we believe:

• These Terms have been violated
• Use of the Services creates risk to UniquelyND or others
• Required by law

You may stop using the Services at any time.

19. Changes to the Services

We may modify, suspend, or discontinue all or part of the Services at any time without liability.

20. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and interpreted under the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.
